The MP High Court has come down heavily on the government in the OBC reservation case. The High Court has stayed the order of the state government giving 27 percent reservation on the recruitment of teachers of OBC category. The High Court in its order has told the state government that reservation cannot be given more than 14 percent to the OBC category.

Leaving the pending cases in the High Court, the Advocate General had earlier given his opinion to the state government to implement 27 percent reservation. After the legal opinion of the Advocate General, the state government had gone through its selection list considering the provision of 27 percent reservation for OBCs in teacher recruitment. Considering the contempt of the High Court, the petitioners filed a petition in the Madhya Pradesh High Court.

The petition was heard on November 18 in a double bench of MP High Court Chief Justice Ravi Malimath and Justice Vijay Shukla. While not giving more than 14 percent reservation to OBC, the double bench has issued notice to the state government and issued notice to the state government while holding the next hearing on December 6.

Advocate Aditya Sanghi of the petitioner said that by giving 27 percent reservation to OBC category and 10 percent to EWS in the recruitment of teachers by the state government, the reservation limit will be 73 percent. There is a provision to give 20 percent reservation to Scheduled Castes, 16 percent to Scheduled Tribes and 14 percent to OBC. Thus it is in violation of the order of the Supreme Court.
