The Supreme Court has expressed concern over the delay in appointment of tribunals. The Supreme Court has asked the Central Government to complete the process of appointing four Judicial Members in the Railway Claims Tribunal immediately as per the approval of the Appointments Committee of the Cabinet. The bench headed by Supreme Court Justice L Nageswara Rao said that the tenure of the members would depend on the decision of this application.
An application was filed in the Supreme Court on behalf of Railway Claims Tribunal Bar Association, Jaipur. The Supreme Court said that on 27 April 2020, the Central Government had said that the process of appointing 17 members would be completed in 15 days. A technical member was appointed on 15 June 2020. But the judicial member could not be appointed. When the case was heard on December 3, 2020, the Central Government had told the Supreme Court that the Judicial Members would be appointed soon.
Senior Advocate Nikhil Nair, appearing on behalf of the petitioner, said that on 21 October 2020, the Cabinet had given approval for the appointment of Judicial Member. He argued that when the approval for the appointment of judicial members has been cleared, then there is no point in delaying the appointment. The Attorney General said that the Supreme Court had said in its Judgment that the tenure would be for five years but in the ordinance of 4 April 2021 of the Central Government, the tenure was reduced to four years. Then the Supreme Court said that the appointment of four judicial members should be done according to the approval of the Cabinet Committee and the tenure will depend on the decision on this application.
