Due to the pressure of the International Court, Pakistan has given a big relief to the jailed Indian citizen Kulbhushan Jadhav. According to the decision of the International Court of Justice, a bill has been passed in the joint sitting of the Parliament of Pakistan to give the right of appeal to Kulbhushan Jadhav. Now Kulbhushan Jadhav will be able to appeal against his sentence in the higher courts. Pakistan claims that they have arrested Indian national Kulbhushan Jadhav from Balochistan province, he was spying for India in Pakistan.

Earlier in June, the National Assembly, the lower house of Pakistan’s parliament, had given its assent to a bill allowing Kulbhushan Jadhav to appeal in higher courts. Kulbhushan Jadhav, who is facing death sentence from the military court, had no right to appeal. On this, the International Court of Justice had reprimanded Pakistan. The Indian Ministry of External Affairs issued a statement on 10 April 2017 saying that Kulbhushan Jadhav has been kidnapped by Pakistan from Iran and they have no evidence that Kulbhushan Jadhav was spying there.

Pakistan made allegations of espionage
The Pakistan government alleges that Kulbhushan Jadhav is a former Indian Navy soldier and was involved in many dangerous activities in Pakistan. He was arrested on 3 March 2016. On this, the Government of India says that Kulbhushan Jadhav is a former naval who has retired from the Navy. Now he had gone to Iran as a businessman where he was kidnapped by Pakistan.

ICJ rebukes Pakistan
Kulbhushan Jadhav was sentenced to death by a Pakistan court on 10 April 2017. On 18 May 2017, the International Court of Justice stayed this decision of Pakistan. The International Court of Justice in The Hague in July 2019 said that Pakistan should “effectively review and reconsider” Jadhav’s conviction and sentence and also grant consular access to India without delay. The International Court of Justice in its decision had said that Pakistan should provide Jadhav a proper forum to appeal against the decision of the military court.
