employees transfer policy in government: employees cannot insist on transfer of employees to any place, employer has the right to transfer: Supreme Court
The Supreme Court has said that no employee can insist on transfer to a particular place and the employer has the right to transfer the employees according to his needs. The apex court said this while dismissing the petition of a lecturer challenging an October 2017 order of the Allahabad High Court. The Supreme Court quashed the application against the rejection of his request by the concerned authority for transfer from Amroha to Gautam Budh Nagar.
A bench of Justice MR Shah and Justice Aniruddha Bose said this in its order dated September 6. The woman teacher posted in Amroha district, in her petition filed in the high court, said that she had requested for transfer to a college in Gautam Budh Nagar and the same was rejected by the authority in September 2017. The woman’s lawyer had argued in the high court in 2017 that she had been working in Amroha for the past four years and was entitled to transfer as per the policy of the government.
The High Court had said that the order passed by the authority concerned shows that the teacher had served in a college in Gautam Budh Nagar for 13 years from her initial appointment in December 2000 to August 2013, hence her request to repatriate to the same college. Is not justified.
