There were communal riots in North-East Delhi in February last year. During these riots, the picture of Shahrukh Pathan, who pointed a pistol at the head constable of Delhi Police, made headlines in the media. The accused told a court on Thursday that he did not fire at the policeman and did not intend to kill the policeman. However, he just wanted to scare.

However, this claim was opposed by the prosecution. The picture of Pathan pointing a pistol at head constable Deepak Dahiya during the riots last year had gone viral on social media. Shahrukh Pathan was arrested on March 3, 2020 and is currently lodged in Tihar Jail.

Senior advocate Maneka Guruswamy, appearing for Pathan, played a 26-second video clip of the incident in the court to show that there was no attempt to kill the policeman. The lawyer said that the accused fired two rounds, one in the air and the other on the right side. After this the accused had an argument with Dahiya and he returned, he said.

Thereafter, Additional Sessions Judge Amitabh Rawat asked the lawyer to replay the video and focus on the position of Pathan’s pistol just before it was fired in the air.

The judge said, “Look at the condition of the gun (pistol). Its aim is straight (on the dahiya). When he is aiming, the gun is straight.

However, the defense counsel clarified that the head constable was not the target of the bullet fired both the times. “The state’s case is based on Dahiya. He is a potential victim and was not shot. The first shot was fired in the air and the second shot to the right.

At the same time, Special Public Prosecutor Anuj Handa, appearing for the police, said that the accused had clearly pointed a pistol at the policeman.

Opposing the defense’s arguments, Handa said, “The gun (pistol) was pointed slightly below the head of the complainant. His hand is moving upwards as he retreats after firing multiple bullets.
